1. Introduction

This Privacy Policy details how we collect, use, and disclose the Personal and Non-Personal Data we collect from and about you when you access or use our online and mobile websites, applications, services, and software; through interactions with us on the phone or in person; or, where permitted by applicable law and in line with this Privacy Policy, that we obtain from publicly available or third-party sources.

Our Sites (the "Sites") covered by this Privacy Policy include the affiliated online and mobile websites, applications, services, and software of Talent Pronto.

1.1. Definitions

Professional

An individual searching for employment openings, services, or information related to their personal employment or job search.

Employer

Individuals and organizations seeking information related to hiring or human resources, seeking Professionals, or seeking to make available information regarding employment openings, on their own or another's behalf, including agencies purchasing for multiple parties and employment agencies.

Personal Data

Any information that relates to an identified or identifiable individual, which can include information about how you engage with our services, such as device information or IP address.

Sensitive Personal Data

A category of personal data revealing racial or ethnic origin; religious or philosophical beliefs; union membership; medical history, mental or physical health condition, treatment or diagnosis; sex life, sexual orientation, sexuality, status as transgender or nonbinary; status as a victim of crime; national origin, citizenship or immigration status; genetic or biometric data processed to uniquely identify an individual; personal data collected from a known child; precise geolocation data; social security, driver's license, state identification card, or passport number; account log-in, financial account, debit or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; and the contents of a consumer's mail, email, and text messages unless the business is the intended recipient.

Non-Personal Data

Any information that does not relate to an identified or identifiable specific individual, for example data relating solely to a business.

Your Information

Personal and Non-Personal Data that pertains to you.

Controller and Processor

A Controller is the entity which decides how and why your data is processed. A Processor is an entity which processes data in a particular way, at the direction of a Controller.

Talent Pronto and Affiliates

"Talent Pronto" means any of Talent Pronto's entities. "Affiliates" means any entity that directly or indirectly controls, is controlled by, or is under common control of or with a Talent Pronto entity, now or in the future. "Control" means having a majority of shares or the right and ability to direct management.

1.2. The scope of this Privacy Policy

This Privacy Policy covers data that we collect through the Sites, directly from data subjects, or that we obtain from third parties. Where you follow a link to a third-party website, you are no longer covered by our Privacy Policy, and any data collection or processing that takes place on that website is governed by that website's own privacy policy. We only collect data on Sites that display a direct link to this Privacy Policy.

In accordance with our Terms, the Sites are generally only for use by people aged 18 or over. In all jurisdictions, if you are under the age of majority in your jurisdiction, you must use the Sites under the supervision of your parent, legal guardian, or responsible adult, even if your age is above the Talent Pronto permitted use age for that jurisdiction.

Talent Pronto will not knowingly collect Personal Information from any child under the age of 13, and we ask that any child under the age of 13 not use the Sites. If a child under 13 has provided Talent Pronto with Personal Information, a parent, legal guardian, or responsible adult may contact us using the details below and request that it be deleted. We adopt a range of measures intended to ensure that no information is knowingly solicited from individuals who do not meet the minimum age or any other applicable age requirements. If we learn that an individual who does not meet the minimum age requirement has used the Sites or provided personal information through them, we will restrict access to or close their account and remove that information from our systems.

2. Information that Talent Pronto collects

Talent Pronto uses different types of information in order to provide our Sites' services, products, and features to you. The Personal Data we collect and process may vary depending on how you use our Sites. If Personal Data is required to provide particular services or features, it will be indicated at the time of collection. If Personal Data is required and you choose not to provide it, that feature or service may not be available to you.

2.1. Retention of your information

Where Talent Pronto acts as a Controller of your Personal Data, we retain it until it is no longer necessary to fulfill the purpose it is being used for, as required by applicable laws, or until you ask us to delete it. In determining appropriate retention periods we consider the purposes for which we process Personal Data and whether we can achieve those purposes through other means, as well as the extent, nature, and sensitivity of the data and our legal obligations. Where possible, and relying on our legitimate interest in improving our Sites, we anonymize or aggregate Personal Data so that it can no longer be associated with or identify a user, in which case we may process the information further.

2.2. Personal Data we collect from all users

2.3.1. Professional profile data

By creating a profile through the Sites, including when you upload a resume, you are requesting and authorizing Talent Pronto to make your profile data available to third parties in accordance with our Terms of Service. Employers and Employer representatives who access your profile data may choose to share your profile with additional parties. Talent Pronto is not responsible for such sharing.

2.3.2. Automated processing of your Personal Data

We may perform automated processing of Personal Data to evaluate specific aspects relating to a user and to analyze and predict a user's preferences and interests. Where we perform this processing, we do so either on the basis of user consent or performance of a contract, where such processing is necessary for us to provide our services to Professionals and Employers.

2.3.3. How we use artificial intelligence

In support of providing Talent Pronto services, we may use personal data to develop, train, build, and use statistical models, including artificial intelligence ("AI"), to improve some of our products. We may use AI to provide candidate highlights, which are a summary of your information, to personalize outreach messages for employers, and to offer job-based matched candidates.

Talent Pronto may in some jurisdictions enable chatbots, which allow you to take certain actions on the Sites. We use the information you share in a chat to provide more personalized responses or relevant information in that conversation. Chatbot responses may be powered by a vendor and will be processed by Talent Pronto and that vendor.

2.3.4. Site activity recording

We may collect, record, process, analyze, and store any and all activities you take on the Sites and affiliated sites, and any interactions and communications you have with, on, or through them. We may also use third parties to collect and process this data on our behalf, in connection with our operations to improve the Sites, protect our users, and optimize our services. This activity data includes which areas of the Sites you visit (including URLs), which content you view, which information you input, whether and where you click, scroll, hover over, mouse over, or otherwise interact or communicate, the timing of each activity, and time spent on each activity. We collect this data from everyone using the Sites, including users of private browsing or incognito modes.

We process your activity to help us better understand how the Sites are used, which helps us improve and inform the products and services we offer. Because this is critical to how our Sites operate, if you do not want your actions collected, recorded, processed, analyzed, or shared in this way, you may need to cease using our Sites.

3. Who we share your data with

3.1. Transfers to our Affiliates

Talent Pronto shares information with Affiliates to improve our services and provide better security for users. The services provided to you and the functionality of the Sites could not be provided without such transfers. If you do not wish your information to be transferred in this way, you should not use the Sites.

3.2. Transfers to Employers

Talent Pronto sends Professional Personal Data to Employers, including on the instruction of Professionals and Employers. Data transferred in this way is processed in accordance with Talent Pronto's Terms and those of the relevant Employer, and may include sending your application or additional candidate information, such as your contact details, to other platforms that process Professional Personal Data for the Employer. Employers agree to comply with all their responsibilities under applicable data protection rules with respect to the collection, processing, and storage of Personal Data, and to provide adequate protection of all data subject rights.

3.3. Transfers to Professionals

Talent Pronto sends certain Employer-related information to Professionals. This can include the Employer representative's name, the Employer's city and state location, whether the Employer has taken or chosen not to take an action regarding the Professional's resume or application (such as opening, viewing, responding to, or making a decision about it), whether the Employer has engaged with other Professionals or viewed other resumes, and whether the Employer has taken an action on a job listing such as pausing or closing it. We do this to help Professionals evaluate employment opportunities.

3.4. Transfers to service providers and other third parties

We use third parties to perform services in connection with our operations, to improve the Sites and our services, products, and features, to protect our users and better understand their needs, and to optimize our services and our users' experiences. By using our Sites you acknowledge Talent Pronto's use of such third parties for the purpose of collecting, processing, analyzing, and recording your activity on, interaction with, and communications with or through our Sites. All transfers of information to service providers are covered by appropriate data agreements and, in the case of cross-border transfers, legal mechanisms for doing so. We may transfer information to provide personalized experiences, improve our services, protect users, or facilitate payments based on our legitimate interest to provide services.

3.5. Links to third-party sites

The Sites may make available links to other third-party websites. When you click such links you may leave our Sites. Your web browser may also disclose to the third-party website the URL of the page you clicked from, and this URL may include search terms and filters you used. Talent Pronto is not responsible for the privacy practices of third parties; please consult their individual privacy policies to learn more.

4. Your Personal Data

We verify all requests through email before taking action on them and reserve the right to deny a request where we are unable to verify your identity satisfactorily. This also applies to requests submitted on your behalf by someone else. If you have any queries or complaints about how we process your Personal Data, we encourage you to contact us.

4.1. The right to rectify or correct inaccuracies

You have the right to rectify, update, or correct inaccuracies in your Personal Data. You can modify much of it by editing your account profile directly, or make a formal request by emailing us from the email address associated with your account.

4.2. The right to delete your Personal Data

You have the right to request that we delete your Personal Data. You can delete much of it directly from your account. To exercise your right to erasure and close your account, email us from the address associated with your account; we will then close and delete your account and remove access to your profile. Where we use a third-party vendor to process Personal Data we control, we will pass on your request and make reasonable requests to inform other controllers. A deletion request only affects your Personal Data: if you submit one against an Employer account, we will delete your Personal Data, and non-Personal Data such as information about your company will not be deleted.

4.3. The right to object to, opt out of, or restrict processing

You have the right to object to, opt out of, and request the restriction of certain types of processing. Where we rely on legitimate interests, you can object and request that we no longer process your Personal Data in that way, unless we have compelling legitimate grounds which override your rights. You also have the right to object or opt out of your personal data being sent to a third party, excluding vendors acting as our service provider or controller, by emailing us from the address associated with your account.

4.4. Opting out of Talent Pronto communication

To opt out of a particular marketing email, click "unsubscribe" (or the equivalent) within the email; this opts you out of that type of message only. You may opt out of all marketing messages by emailing us, and we will comply as soon as reasonably practicable and in accordance with applicable laws. 4.5. Limiting the use of Sensitive Personal Data

Some states require Talent Pronto to obtain consent prior to the collection of sensitive personal information. All sensitive data we collect is collected with your consent, or as permitted or required under applicable laws, including some demographic data. Some states provide users the right to limit the use and disclosure of sensitive personal information beyond what is necessary to perform the services as reasonably expected by users.

4.6. The right to opt out of sale and targeted advertising

You have the right to opt out of the processing of your personal data for purposes of sale. Personal data is "sold" when provided to a third party for monetary or other valuable consideration, a broad term which may cover sharing data with our Affiliates. You also have the right to opt out of processing for targeted advertising (also known as "share" under CCPA). To opt out of either, email us from the account associated with your account.

4.7. The right to opt out of profiling with legal effect

You have the right to opt out of the processing of personal data for purposes of profiling in furtherance of a decision that produces a legal or similarly significant effect. To opt out, email us from the address associated with your account.

4.8. The right to non-discrimination

You have a right not to be discriminated against for exercising any of your rights.

4.9. The right to an authorized agent

You have the right to designate another person to make a request on your behalf. We verify all requests through email before taking action and reserve the right to deny a request where we cannot verify identity satisfactorily.

4.10. Limitations

These rights may be subject to certain limitations provided for by applicable laws in relevant markets. Requests will be completed within the time allotted by relevant regulations, running from the point at which we confirm your request. Where permitted, there may be a charge for subsequent requests from the same individual, determined by Talent Pronto and imposed only to the extent permitted by applicable law.

5. Security

Talent Pronto uses reasonable security measures to help protect your personal data against loss, misuse, alteration, or unauthorized access, and performs regular vulnerability assessments of our systems and network. However, no method of transmission or electronic storage of information via the internet can be 100% secure. For example, emails or other messages sent via your web browser, or resumes shared with employers, may not be encrypted by the recipient. Where the security of your information is beyond our control, we cannot guarantee its privacy.

6. Cookies and tracking technologies

When you visit the Sites, and in some of our advertisements on third-party websites, we use cookies, web beacons, and other similar technologies for measurement services, better targeting of advertisements, and marketing purposes. By using or accessing our websites, you agree to Talent Pronto's use of cookies as outlined below (the "Cookie Policy"). Review the "Last updated" date at the top of this page to determine when it was last amended; by using the Sites or providing information to us following such changes, you accept this Cookie Policy.

6.1. What cookies are and how we use them

Cookies are small text files placed on your device that allow a website to recognize your browser and remember information about your visit. We use strictly necessary cookies to operate the Sites and keep them secure; functional cookies to remember your preferences and log-in state; analytics cookies to understand how the Sites are used so we can improve them; and advertising cookies to measure and target our marketing. Where required by applicable law, we obtain your consent before setting non-essential cookies.

6.2. Managing cookies

Most browsers let you refuse or delete cookies through their settings, and mobile devices offer controls for advertising identifiers. If you block strictly necessary cookies, parts of the Sites may not function as intended. Because cookie and tracking data is critical to how our Sites operate, if you do not want this data collected you may need to cease using our Sites.
